These Terms of Use (“Terms”) govern access to and use of the Many Ways professional platform, available notably at https://shop.many-ways.ch/

The platform is operated by:

Using the platform implies acceptance of these Terms.

The platform is intended mainly for B2B use by companies, organizations, associations, institutions and professionals wishing to discover and customize products offered by Many Ways SA.

It notably allows users to:

• browse the product catalogue; • search for and select items; • view available characteristics and options; • preview certain customization possibilities; • build a product selection; • send a quote or information request to Many Ways SA.

Many Ways SA strives to present information that is as accurate and current as possible.

However, products, photographs, dimensions, colours, materials, prices, stock, delivery times, minimum quantities and customization options shown on the platform may depend on information provided by the manufacturers, brands, suppliers and partners of Many Ways SA.

This information is therefore indicative and may be changed without notice.

Photographs, digital renderings and product representations are non-binding. Differences may appear in colours, proportions, textures or customization renderings.

Unless otherwise stated, any prices shown on the platform are indicative and intended for professional customers.

The final price depends notably on the quantity ordered, the selected product, the type of customization, the number of colours, technical costs, packaging, transport and any additional services.

Only the commercial offer or order confirmation issued by Many Ways SA determines the final applicable prices and terms.

The platform is mainly a browsing and quote request tool.

No payment is made directly on the platform.

Adding a product to a selection, using a configurator, sending a quote request or any similar action is neither a firm order nor the conclusion of a sales contract.

After receiving a request, Many Ways SA may issue a commercial offer specifying notably the products, quantities, customizations, prices, lead times and applicable terms.

The commercial relationship is entered into under the terms of the offer or order confirmation accepted by the customer.

Some features may require creating an account.

The user undertakes to provide accurate information and keep it up to date.

Account credentials are personal and confidential. The user is responsible for safeguarding them and must inform Many Ways SA as soon as possible of any unauthorized use or suspected compromise of their account.

Many Ways SA reserves the right to suspend or delete an account in case of abusive or fraudulent use, or use contrary to these Terms.

As part of a customization request, the user may submit logos, trademarks, texts, photographs, illustrations, graphic files or other content to Many Ways SA.

The user warrants that they hold the rights and authorizations needed to use and submit these elements to Many Ways SA for the purpose of fulfilling the request.

The user authorizes Many Ways SA and, where necessary to fulfil the request, its suppliers and production partners to use these elements solely for preparing, simulating, quoting and producing the relevant products.

Many Ways SA cannot be held liable for any infringement of third-party rights resulting from an element submitted by the user without the necessary authorizations.

Many Ways SA strives to keep the platform regularly available.

Access may nevertheless be temporarily interrupted, notably for maintenance, updates, security, technical failure or any other circumstance beyond the control of Many Ways SA.

Many Ways SA does not guarantee permanent or error-free access to the platform.

The user undertakes to use the platform in accordance with its purpose and applicable law.

In particular, it is prohibited to:

• use the platform for fraudulent or unlawful purposes; • attempt to gain unauthorized access to the platform's systems or data; • disrupt or compromise its operation or security; • use automated means to mass-extract the catalogue or platform data without prior authorization; • copy, reproduce or commercially exploit the catalogue or content of Many Ways SA without authorization; • upload files containing malware or any other element likely to damage computer systems.

The platform, its structure, its interface and the texts, photographs, illustrations, graphic creations, databases and other content that make it up are protected by applicable intellectual property rights.

Unless otherwise stated, these elements belong to Many Ways SA or are used with the permission of their owners.

Trademarks, names, logos, photographs and content belonging to manufacturers, suppliers and partners listed on the platform remain the property of their respective owners.

Access to the platform grants the user no intellectual property rights over these elements.

Many Ways SA strives to ensure the quality and accuracy of the information offered on the platform but does not guarantee that it is at all times complete, up to date or error-free.

To the extent permitted by applicable law, Many Ways SA disclaims all liability for damages resulting notably from:

• temporary unavailability of the platform; • erroneous or outdated information provided by a manufacturer, supplier or partner; • use of the platform contrary to its purpose; • unauthorized access resulting from the user's failure to keep their credentials confidential.

Final characteristics, prices, stock and lead times are those confirmed by Many Ways SA in the course of the commercial relationship with the customer.

Many Ways SA processes the personal data necessary for the operation of the platform in accordance with the Federal Act on Data Protection (FADP) and other applicable legal provisions.

The terms of collection, use, retention and protection of personal data are set out in the Privacy Policy available on the platform.

The platform may contain links to websites, catalogues, resources or services operated by third parties.

Many Ways SA has no control over these external services and is not responsible for their content, availability or their own data protection practices.

Many Ways SA may amend these Terms, notably to reflect changes to the platform, its services or legal and regulatory requirements.

The applicable version is the one available on the platform at the time of use.

In case of a substantial change affecting users with an account, Many Ways SA may inform them by appropriate means.

These Terms are governed by Swiss law, excluding its conflict-of-law rules.

Subject to mandatory places of jurisdiction provided by applicable law, any dispute relating to the use of the platform falls under the jurisdiction of the courts of the Canton of Vaud, Switzerland.
